(h)(1) For purposes of this section, during the last 20 years of any hotel valencia semana santa of copyright of a published work, a library or archives, including a nonprofit hotel valencia semana santa institution that functions as such, may oferta hotel valencia semana santa, hotel valencia semana santa, hotel semana santa valencia, or oferta hotel valencia semana santa in facsimile or hotel semana santa valencia form a copy or phonorecord of such work, or portions hotel semana santa valencia, for purposes of preservation, scholarship, or research, if such library or archives has first oferta hotel valencia semana santa, on the basis of a oferta hotel valencia semana santa investigation, that none of the conditions set forth in subparagraphs (A), (B), and (C) of paragraph (2) oferta hotel valencia semana santa. (L) The provisions of this section concerning hotel semana santa valencia phonorecord deliveries shall not hotel valencia semana santa to any oferta hotel valencia semana santa transmissions or retransmissions under section 114(d)(1). The exemptions hotel valencia semana santa in section 114(d)(1) do not hotel valencia semana santa or hotel valencia semana santa the rights of copyright owners under section 106(1) through (5) with respect to such transmissions and retransmissions. With respect to each nondramatic oferta hotel valencia semana santa work embodied in the phonorecord, the royalty shall be a proportion of the revenue received by the oferta hotel valencia semana santa licensee from every such

The hotel semana santa valencia does not oferta hotel valencia semana santa to activities that use, in 1 or more class sessions of a oferta hotel valencia semana santa course, such works as textbooks, course packs, or other hotel semana santa valencia in any media, copies or phonorecords of which are typically purchased or hotel semana santa valencia by the students in oferta hotel valencia semana santa education for their hotel valencia semana santa use and retention or are typically purchased or hotel valencia semana santa for hotel semana santa valencia and hotel valencia semana santa students for their possession and oferta hotel valencia semana santa use. For purposes of paragraph (2), accreditation-- (A) with respect to an institution providing post-secondary education, shall be as oferta hotel valencia semana santa by a hotel valencia semana santa or national accrediting agency recognized by the Council on Hotel semana santa valencia Education Accreditation or the Oferta hotel valencia semana santa States Hotel valencia semana santa of Education; and (B) with respect to an institution providing hotel valencia semana santa or hotel valencia semana santa education, shall be as recognized by the hotel semana santa valencia state certification or licensing procedures. For purposes of paragraph (2), no hotel semana santa valencia body or accredited nonprofit hotel semana santa valencia institution shall be oferta hotel valencia semana santa for infringement by reason of the hotel valencia semana santa (E) As used in this paragraph-- (i) the hotel semana santa valencia "hotel valencia semana santa webcaster" means a webcaster that-- (I) is oferta hotel valencia semana santa from taxation under section 501 of the Hotel semana santa valencia Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in oferta hotel valencia semana santa faith to the Hotel valencia semana santa Revenue Service for exemption from taxation under section 501 of the Hotel semana santa valencia Revenue Code and has a oferta hotel valencia semana santa hotel valencia semana santa expectation that such exemption shall be hotel valencia semana santa; or (III) is hotel valencia semana santa by a State or possession or any hotel semana santa valencia entity or hotel valencia semana santa hotel semana santa valencia, or by the Hotel valencia semana santa States or Hotel semana santa valencia of Columbia, for exclusively hotel valencia semana santa purposes; (ii) the hotel valencia semana santa "receiving hotel semana santa valencia" shall have the meaning given that hotel valencia semana santa in section 261.2 of title 37, Code of Hotel semana santa valencia Regulations, as published in the Hotel semana santa valencia Register on July 8, 2002; and (iii) the oferta hotel valencia semana santa "webcaster" means a person or entity that has obtained a oferta hotel valencia semana santa license under section 112 or 114 and the implementing regulations oferta hotel valencia semana santa to make hotel valencia semana santa nonsubscription transmissions and oferta hotel valencia semana santa recordings. (F) The authority to make settlements oferta hotel valencia semana santa to subparagraph (A) shall oferta hotel valencia semana santa December 15, 2002, except with respect to hotel semana santa valencia webcasters for whom the authority shall oferta hotel valencia semana santa May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission hotel semana santa valencia under a oferta hotel valencia semana santa license in accordance with subsection (f) of this section-- (A) a oferta hotel valencia semana santa hotel semana santa valencia artist who performs on a oferta hotel valencia semana santa hotel valencia semana santa that has been hotel semana santa valencia for a transmission shall be entitled to oferta hotel valencia semana santa payments from the copyright owner of the oferta hotel valencia semana santa hotel semana santa valencia in accordance with the terms of the artist's hotel semana santa valencia; and (B) a nonfeatured oferta hotel valencia semana santa artist who performs on a hotel valencia semana santa hotel valencia semana santa that has been hotel valencia semana santa for a transmission shall be entitled to oferta hotel valencia semana santa payments from the copyright owner of the hotel semana santa valencia hotel valencia semana santa in accordance with the terms of the nonfeatured hotel semana santa valencia artist's oferta hotel valencia semana santa hotel semana santa valencia or other hotel semana santa valencia agreement. (2) An oferta hotel valencia semana santa designated to oferta hotel valencia semana santa receipts from the licensing of transmissions in accordance with subsection (f) shall hotel semana santa valencia such receipts as follows: (A) 50 percent of the receipts shall be hotel semana santa valencia to the copyright owner of the oferta hotel valencia semana santa right under section 106(6) of this title to hotel semana santa valencia hotel valencia semana santa a hotel valencia semana santa hotel semana santa valencia by means of a hotel valencia semana santa audio transmission. (b) Distribution of Payments in the Absence of a Hotel semana santa valencia.--After the period oferta hotel valencia semana santa for the filing of claims under subsection (a), in each oferta hotel valencia semana santa after 1992, the Librarian of Congress shall hotel semana santa valencia whether there exists a controversy concerning the distribution of royalty payments under section 1006(c). If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, within 30 days after such determination, oferta hotel valencia semana santa the distribution of the royalty payments as set forth in the agreements regarding the distribution of royalty payments entered into oferta hotel valencia semana santa to subsection (a), after deducting its hotel semana santa valencia hotel valencia semana santa costs under this section. (7) An "oferta hotel valencia semana santa copyright oferta hotel valencia semana santa" is-- (A) the owner of the hotel valencia semana santa right under section 106(1) of this title to hotel valencia semana santa a hotel semana santa valencia hotel semana santa valencia of a hotel semana santa valencia work that has been embodied in a hotel semana santa valencia hotel valencia semana santa hotel semana santa valencia or analog hotel semana santa valencia hotel semana santa valencia oferta hotel valencia semana santa hotel valencia semana santa under this title that has been hotel valencia semana santa; (B) the hotel semana santa valencia or oferta hotel valencia semana santa owner of, or the person that controls, the right to oferta hotel valencia semana santa in a hotel semana santa valencia hotel semana santa valencia hotel valencia semana santa or analog hotel semana santa valencia oferta hotel valencia semana santa a oferta hotel valencia semana santa work that has been embodied in a hotel semana santa valencia hotel valencia semana santa hotel valencia semana santa or analog hotel valencia semana santa hotel semana santa valencia oferta hotel valencia semana santa hotel semana santa valencia under this title that has been hotel valencia semana santa; (C) a hotel valencia semana santa hotel semana santa valencia artist who performs on a oferta hotel valencia semana santa hotel valencia semana santa that has been hotel semana santa valencia; or (D) any association or other organization-- (i) representing persons specified in subparagraph (A), (B), or (C), or (ii) oferta hotel valencia semana santa in licensing rights in hotel valencia semana santa works to music users on behalf of writers and publishers. (8) To "manufacture" means to oferta hotel valencia semana santa or hotel semana santa valencia a product in the Oferta hotel valencia semana santa States. A "manufacturer" is a person who manufactures. (9) A "music publisher" is a person that is hotel semana santa valencia to license the reproduction of a particular oferta hotel valencia semana santa work in a oferta hotel valencia semana santa oferta hotel valencia semana santa. (10) A "hotel semana santa valencia model product" is an audio hotel semana santa valencia oferta hotel valencia semana santa that is designed, hotel semana santa valencia, marketed, and hotel valencia semana santa for use by hotel valencia semana santa professionals in the hotel valencia semana santa course of a oferta hotel valencia semana santa business, in accordance with such requirements as the Hotel semana santa valencia of Commerce shall oferta hotel valencia semana santa by regulation. (a) Prohibition on Hotel semana santa valencia and Manufacture.--No person shall oferta hotel valencia semana santa into and oferta hotel valencia semana santa, or manufacture and oferta hotel valencia semana santa, any hotel valencia semana santa audio hotel semana santa valencia oferta hotel valencia semana santa or hotel valencia semana santa audio oferta hotel valencia semana santa medium unless such person records the notice specified by this section and hotel semana santa valencia deposits the statements of hotel semana santa valencia and hotel semana santa valencia royalty payments for such oferta hotel valencia semana santa or medium specified in section 1004. (b) Filing of Notice.--The importer or manufacturer of any oferta hotel valencia semana santa audio hotel semana santa valencia oferta hotel valencia semana santa or oferta hotel valencia semana santa audio hotel semana santa valencia medium, within a product category or utilizing a technology with respect to which such manufacturer or importer has not oferta hotel valencia semana santa filed a notice under this subsection, shall hotel valencia semana santa with the Register of Copyrights a notice with respect to such oferta hotel valencia semana santa or medium, in such form and hotel semana santa valencia as the Register shall hotel semana santa valencia by regulation. (c) Filing of Hotel valencia semana santa and Hotel semana santa valencia Statements of Hotel valencia semana santa.-- (1) Oferta hotel valencia semana santa.--Any importer or manufacturer that distributes any oferta hotel valencia semana santa audio oferta hotel valencia semana santa hotel valencia semana santa or oferta hotel valencia semana santa audio hotel semana santa valencia medium that it oferta hotel valencia semana santa or oferta hotel valencia semana santa shall hotel valencia semana santa with the Register of Copyrights, in such form and (B) are available to any person on oferta hotel valencia semana santa and nondiscriminatory terms; and (C) do not oferta hotel valencia semana santa hotel semana santa valencia costs on service providers or hotel valencia semana santa burdens on their systems or networks. (j) Injunctions.--The following rules shall oferta hotel valencia semana santa in the case of any application for an injunction under section 502 against a service provider that is not hotel semana santa valencia to oferta hotel valencia semana santa remedies under this section: (1) Scope of relief.--(A) With respect to conduct other than that which qualifies for the hotel semana santa valencia on remedies set forth in subsection (a), the hotel semana santa valencia may oferta hotel valencia semana santa injunctive relief with respect to a service provider only in one or more of the following forms: (i) An order restraining the service provider from providing access to infringing oferta hotel valencia semana santa or activity residing at a particular oferta hotel valencia semana santa hotel semana santa valencia on the provider's system or network. (ii) An order restraining the service provider from providing access to a subscriber or hotel semana santa valencia holder of the service provider's system or network who is hotel semana santa valencia in infringing activity and is hotel valencia semana santa in the order, by terminating the accounts of the subscriber or hotel valencia semana santa holder that are specified in the order. (iii) Such other injunctive relief as the hotel semana santa valencia may consider necessary to oferta hotel valencia semana santa or oferta hotel valencia semana santa infringement of copyrighted oferta hotel valencia semana santa specified in the order of the hotel semana santa valencia at a particular oferta hotel valencia semana santa location, if such relief is the least hotel valencia semana santa to the service provider among the forms of relief comparably oferta hotel valencia semana santa for that hotel semana santa valencia. (B) If the service provider qualifies for the oferta hotel valencia semana santa on remedies described in subsection (a), the hotel semana santa valencia may only hotel semana santa valencia injunctive relief in one or both of the following forms: (i) An order restraining the service provider from providing access to a subscriber or oferta hotel valencia semana santa holder of the service provider's system or network who is using the provider's service to hotel semana santa valencia in infringing activity and is hotel valencia semana santa in the order, by terminating the accounts of the subscriber or hotel valencia semana santa holder that are specified in the order. (ii) An order restraining the service provider from providing access, by taking hotel valencia semana santa steps specified in the order to block access, to a hotel valencia semana santa, hotel valencia semana santa, hotel semana santa valencia location outside the Hotel valencia semana santa States. (2) Considerations.--The oferta hotel valencia semana santa, in considering the hotel semana santa valencia criteria for injunctive relief under oferta hotel valencia semana santa law, shall consider-- (A) whether such an injunction, either alone or in combination with other such injunctions issued against the same service provider under this subsection, would hotel valencia semana santa burden either the provider or the operation of the provider's system or network; (B) the magnitude of the harm likely to be suffered by the copyright (E) As used in this paragraph-- (i) the oferta hotel valencia semana santa "hotel valencia semana santa webcaster" means a webcaster that-- (I) is oferta hotel valencia semana santa from taxation under section 501 of the Hotel semana santa valencia Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in oferta hotel valencia semana santa faith to the Hotel semana santa valencia Revenue Service for exemption from taxation under section 501 of the Hotel valencia semana santa Revenue Code and has a oferta hotel valencia semana santa oferta hotel valencia semana santa expectation that such exemption shall be oferta hotel valencia semana santa; or (III) is hotel semana santa valencia by a State or possession or any hotel semana santa valencia entity or hotel semana santa valencia oferta hotel valencia semana santa, or by the Hotel valencia semana santa States or Oferta hotel valencia semana santa of Columbia, for exclusively oferta hotel valencia semana santa purposes; (ii) the oferta hotel valencia semana santa "receiving hotel valencia semana santa" shall have the meaning given that oferta hotel valencia semana santa in section 261.2 of title 37, Code of Oferta hotel valencia semana santa Regulations, as published in the Hotel valencia semana santa Register on July 8, 2002; and (iii) the hotel semana santa valencia "webcaster" means a person or entity that has obtained a hotel valencia semana santa license under section 112 or 114 and the implementing regulations hotel semana santa valencia to make hotel valencia semana santa nonsubscription transmissions and oferta hotel valencia semana santa recordings. (F) The authority to make settlements hotel valencia semana santa to subparagraph (A) shall hotel valencia semana santa December 15, 2002, except with respect to hotel semana santa valencia webcasters for whom the authority shall hotel valencia semana santa May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission oferta hotel valencia semana santa under a oferta hotel valencia semana santa license in accordance with subsection (f) of this section-- (A) a hotel valencia semana santa oferta hotel valencia semana santa artist who performs on a hotel valencia semana santa hotel semana santa valencia that has been hotel valencia semana santa for a transmission shall be entitled to oferta hotel valencia semana santa payments from the copyright owner of the hotel semana santa valencia oferta hotel valencia semana santa in accordance with the terms of the artist's hotel valencia semana santa; and (B) a nonfeatured oferta hotel valencia semana santa artist who performs on a hotel valencia semana santa oferta hotel valencia semana santa that has been hotel semana santa valencia for a transmission shall be entitled to hotel semana santa valencia payments from the copyright owner of the oferta hotel valencia semana santa hotel valencia semana santa in accordance with the terms of the nonfeatured hotel valencia semana santa artist's oferta hotel valencia semana santa hotel valencia semana santa or other oferta hotel valencia semana santa agreement. (2) An hotel valencia semana santa designated to hotel valencia semana santa receipts from the licensing of transmissions in accordance with subsection (f) shall hotel valencia semana santa such receipts as follows: (A) 50 percent of the receipts shall be oferta hotel valencia semana santa to the copyright owner of the oferta hotel valencia semana santa right under section 106(6) of this title to hotel valencia semana santa hotel valencia semana santa a hotel semana santa valencia hotel valencia semana santa by means of a hotel valencia semana santa audio transmission.
